Security Deposit Evidence Checklist

Before disputing a deduction or missing refund, build one file containing the security arrangement, final ledger, move-out chronology, condition evidence, deduction support and property-state source.

First identify whether the payment was actually refundable cash.

Traditional cash deposits and deposit-alternative products can use different documents and economics. Do not apply a cash-deposit refund deadline to a premium or surety product until the arrangement is classified.

Build the security-deposit file in layers

1. Identify the security arrangement

  • Lease and security-deposit addendum
  • Receipt or ledger entry showing the original payment
  • Any document showing whether the payment was refundable cash
  • If an alternative product was used, preserve the premium, policy, bond or waiver terms separately

2. Preserve the final account

  • Final resident ledger
  • Move-out statement or deposit accounting
  • Every deduction line and credit
  • Proof of the refund amount actually sent or received

3. Preserve move-out timing records

  • Lease or tenancy end date
  • Physical move-out date when documented
  • Key return, possession surrender or other handoff record
  • Date any forwarding address was provided
  • Dates the accounting and refund were sent or received

4. Preserve condition evidence

  • Move-in photos or inspection checklist
  • Move-out photos or video
  • Move-out inspection report when one exists
  • Written notices about preexisting damage or repairs during the tenancy

5. Preserve support for each deduction

  • Invoices, receipts, estimates or work orders
  • Photos tied to the specific charged condition
  • Replacement or cleaning records when those are the basis of the deduction
  • Any calculation showing how the charged amount was reached

6. Separate the state-source question

  • Property state and any relevant local jurisdiction
  • Verified deposit return and itemization source
  • The specific trigger event the source uses for timing
  • Any state-specific deduction, limit, interest or documentation rule relevant to the issue

Use move-out evidence for deduction questions

A condition dispute is easier to review when move-in condition, move-out condition and the charged repair or cleaning record are tied to the same item. General apartment photos may be less useful than evidence connected to the exact deduction.

Reconcile the final account separately

Keep the original deposit, final rent or utility charges, deduction lines, credits and actual refund separate. Matching arithmetic does not establish whether each deduction is supported or permitted.

Read the state rule before calculating a deadline

The trigger for a return or accounting period can differ by state. Identify the source-defined trigger first, then enter the date that actually matches that trigger into the calculator.

Ask for the exact missing support

If the record remains incomplete, request the specific itemization, invoice, receipt, inspection record, ledger entry, refund record or condition evidence needed to verify the disputed deduction or missing refund.

Educational evidence organizer only. A complete or incomplete document file does not by itself decide whether a deduction, refund timing issue or deposit product is lawful.
