Iowa Rent Late Fee Limits: $12/$60 or $20/$100 (2026)

Iowa Code § 562A.9(4) uses a two-tier late-fee ceiling. If monthly rent does not exceed $700, a rental agreement may not provide for more than $12 per day or $60 total per month. If monthly rent is greater than $700, the ceiling is $20 per day or $100 total per month. The section sets amount limits; it does not itself create one universal statewide grace period before a late fee begins.

Statewide grace period in § 562A.9Not specified

Use the actual due date and any applicable lease or other legal timing rule rather than inventing a statewide waiting period from this subsection.

Start with the monthly rent amount

The first Iowa calculation checkpoint is whether the rental agreement uses monthly rent of $700 or less, or monthly rent greater than $700. That threshold determines the applicable daily and monthly ceilings.

Preserve the executed lease and any rent-change notice so the rent amount used for the fee period is documented.

Apply both the daily ceiling and the monthly ceiling

For rent of $700 or less, the agreement may not provide for a late fee above $12 per day or $60 total per month. For rent above $700, the limits are $20 per day and $100 total per month.

A daily fee that looks compliant on one day can still exceed the monthly ceiling after several days. Compare both numbers instead of checking only the daily rate.

Do not turn the monthly cap into an automatic fee

The statute limits what a rental agreement may provide; it does not say every landlord may automatically charge the full $60 or $100. Use the actual late-fee term in the rental agreement and the actual number of chargeable days, then apply the statutory ceiling.

Keep timing separate from the amount formula

Section 562A.9(4) supplies the amount ceilings but does not itself state one statewide grace period. Identify the contractual rent due date, any lease grace language and any other applicable timing rule before counting late-fee days.

Documents to compare

  • Executed rental agreement showing monthly rent and late-fee terms.
  • Rent-change notice if the monthly rent changed before the fee period.
  • Resident ledger showing each late-fee posting date and amount.
  • Payment confirmations or bank records.
  • Any lease grace-period or payment-timing language.
  • Monthly ledger total to confirm the aggregate late fee did not exceed the applicable $60 or $100 ceiling.

Compare this issue across states

Iowa uses a daily ceiling plus a monthly ceiling. For rent at or below $700, compare the lease formula with $12 per day and $60 per month. For rent above $700, compare it with $20 per day and $100 per month. The statute limits the fee; it does not automatically authorize the maximum amount or provide one universal statewide grace period.
