Rent Payment, Late Fee & Processing Charge

Separate these four charge types

• Rent late fee: tied to when the rent obligation was due and when the required amount was actually paid.
• Credit/debit card processing fee: tied to the payment method rather than lateness.
• Returned-payment / NSF charge: tied to a payment that did not clear or was returned.
• Utility or billing-service late charge: can be separate from the landlord’s rent late fee.

Documents worth gathering

• Lease section stating rent due date, grace period and late-fee terms.
• Resident ledger showing the posting date and exact fee label.
• Payment confirmation, bank record or card receipt.
• Notice of a declined or returned payment.
• Payment-method disclosure showing any processing charge.
• Utility statement if the fee appears on a third-party bill.
• Any state-specific fee disclosure or exception referenced by the company.

Questions to work through

1. Was the payment actually late under the lease and applicable state rule?
2. Did a partial payment leave an unpaid balance after the grace period?
3. Was the extra amount generated solely because a credit or debit card was used?
4. Was the payment returned, and what notice documents the failure?
5. Is the fee on the rent ledger or on a separate utility/billing statement?
