Security Deposit Deductions

Understand the records and timing questions to review when some or all of a deposit is withheld.

Start with the facts behind the charge

Security deposit disputes often turn on timing, documentation, the reason for each deduction and evidence about the condition of the unit. State rules differ substantially.

Documents worth gathering

  • Deposit accounting or deduction statement
  • Move-in and move-out condition evidence
  • Receipts, invoices or estimates
  • Lease and deposit addenda
  • Dates of move-out, notice and payment

Questions to work through

  1. Was an itemized explanation provided?
  2. When was the tenancy considered ended?
  3. What evidence supports each deduction?
  4. Which deductions are damage, cleaning, unpaid amounts or other items?
  5. What state-specific deadline applies?

There is no single U.S. deposit deadline

Verified state deadlines on RentBillCheck currently range from 14 days in some states to 45 days in Virginia, with states such as Florida, North Carolina and Colorado using more complicated multi-step or extendable timelines.
